PARTIES AND SCOPE This EULA is between the person or entity using the Software ("you" or "User") and noinbox.dev, with software authored by M. Landveld ("Provider", "we", "us", or "our"). Nothing in this EULA restricts rights that cannot lawfully be restricted, including mandatory rights relating to interoperability, decompilation, backup, security research, or other acts expressly permitted by applicable law. 6. SOFTWARE PROVIDED "AS IS" TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT ANY VOLUNTARY, COMMERCIAL, OR CONTRACTUAL WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROVIDER DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, OR OTHER WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, COMPATIBILITY, PERFORMANCE, OR ERROR-FREE OPERATION. Provider does not warrant that the Software will meet your requirements, operate without interruption, be free from defects or harmful components, preserve data without loss, remain compatible with future systems, or produce any particular result. THIS SECTION DOES NOT EXCLUDE, RESTRICT, OR REPLACE ANY STATUTORY GUARANTEE, CONFORMITY RIGHT, REMEDY, OR OTHER MANDATORY CONSUMER RIGHT THAT CANNOT LAWFULLY BE WAIVED OR LIMITED. 7. USE AT YOUR OWN RISK You use the Software at your own risk to the fullest extent permitted by applicable law. You are responsible for evaluating the Software before relying on it and for maintaining backups and recovery procedures. You accept the risks associated with software use, including possible data loss, corruption, incompatibility, interruption, configuration errors, security issues, loss of productivity, and unexpected behavior. The Software is not designed or represented as fail-safe or suitable for use in nuclear facilities, aviation or aircraft control, emergency systems, life-support systems, medical diagnosis or treatment, weapons systems, or any other environment in which failure could reasonably lead directly to death, personal injury, or severe physical or environmental damage. 8. NO PROFESSIONAL ADVICE Unless expressly stated otherwise in a separate written agreement, the Software and related materials do not constitute legal, financial, accounting, medical, engineering, safety, project-management certification, or other regulated professional advice. Any templates, dashboards, calculations, schedules, plans, recommendations, or organizational tools are provided for general informational and productivity purposes. You remain responsible for professional review and for decisions made using the Software. 9. DATA AND BACKUPS Provider does not guarantee that locally stored files, browser storage, databases, exports, journals, project files, settings, or other data will be preserved. You are solely responsible for maintaining independent backups of information that is important to you. Unless a specific Software product expressly states that it transmits or stores data on Provider-operated servers, you should not assume that Provider possesses a recoverable copy of your data. 10. THIRD-PARTY SOFTWARE, SERVICES, AND LINKS The Software may depend on, interact with, link to, or include components supplied by third parties. Provider does not control and is not responsible for third-party products, services, websites, operating systems, libraries, APIs, hosting providers, payment providers, or other external systems. Third-party components may be governed by separate terms and privacy policies. 11. UPDATES, CHANGES, AND DISCONTINUATION Provider may, subject to applicable law, modify, update, suspend, or discontinue the Software or any feature at any time. Unless mandatory law or a separate written agreement requires otherwise, Provider is not obligated to provide maintenance, technical support, upgrades, patches, compatibility updates, or new versions. Where applicable consumer law requires updates, conformity, remedies, or notices, those mandatory obligations remain unaffected. 12. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROVIDER, M. LANDVELD, NOINBOX.DEV, AND THEIR CONTRIBUTORS, CONTRACTORS, OR DISTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS OR DAMAGE, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, PRODUCTIVITY, DATA, FILES, OR USE, ARISING OUT OF OR RELATED TO THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOR CLAIMS THAT MAY LAWFULLY BE LIMITED, THE AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU DIRECTLY TO PROVIDER FOR THE SPECIFIC SOFTWARE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. IF THE SOFTWARE WAS PROVIDED FREE OF CHARGE, ANY LIABILITY LIMITATION WILL APPLY ONLY TO THE EXTENT THAT SUCH A LIMITATION IS LAWFUL AND FAIR UNDER APPLICABLE LAW. Nothing in this EULA excludes or limits liability where exclusion or limitation is prohibited by law, including liability or rights that applicable law makes non-excludable. 13. INDEMNITY FOR UNLAWFUL OR UNAUTHORIZED USE To the extent permitted by applicable law, and primarily in connection with business or professional use, you agree to be responsible for losses, claims, or reasonable costs arising from your unlawful use of the Software, your material breach of this EULA, or your infringement of third-party rights. This section does not require a consumer to indemnify Provider where doing so would be unlawful, unfair, or unenforceable. 14. TERMINATION This license terminates automatically if you materially breach this EULA and fail to cure the breach where applicable law requires an opportunity to cure. Upon termination, you must stop using and distributing the affected Software, except to the extent you retain rights under applicable law or a separate license. 15. GOVERNING LAW AND MANDATORY CONSUMER RIGHTS To the extent a governing law may validly be chosen, this EULA is governed by the laws of the Netherlands, without prejudice to mandatory conflict-of-law rules. If you are a consumer, this choice of law does not deprive you of mandatory protections granted by the law that would apply to you in the absence of this choice, including protections associated with your habitual country of residence where applicable. Nothing in this EULA restricts any mandatory right to bring proceedings before a court that applicable law makes available to you. 16. SEVERABILITY If any provision of this EULA is held invalid, unlawful, unfair, or unenforceable, that provision shall be interpreted or limited only to the minimum extent necessary, where legally permitted, and the remaining provisions will continue in effect to the extent permitted by law. 17. ENTIRE AGREEMENT AND PRIORITY This EULA, together with any product-specific terms expressly incorporated into it, constitutes the agreement concerning the license to the Software. If mandatory law conflicts with this EULA, mandatory law controls. If a third-party component has its own license, that license controls for that component. 18.
