SERVICE LEVEL AND SUPPORT TERMS (SLA) Effective Date: October 6, 2026 Last Updated: October 19, 2026 Author: M. Landveld Provider / Company: noinbox.dev Website: https://noinbox.dev Copyright © 2026 M. Landveld. Published by noinbox.dev. All Rights Are Reserved. 1. PURPOSE These Service Level and Support Terms ("SLA") describe the default availability, maintenance, support, and service-level terms for all current and future software downloads, Windows installers, portable packages, website functions, and related services made available by noinbox.dev. This SLA does not create a paid or guaranteed service level unless noinbox.dev and the customer have entered into a separate written agreement expressly stating guaranteed service levels. 2. NO GUARANTEED AVAILABILITY Unless a separate written agreement expressly states otherwise, no uptime percentage, response time, restoration time, support-response time, download speed, data-retention period, recovery objective, or other service-level commitment is guaranteed. To the fullest extent permitted by applicable law, the website, downloads, software, support channels, and related services are provided "AS IS" and "AS AVAILABLE." Availability may be affected by maintenance, updates, security measures, hosting providers, network failures, third-party services, abuse prevention, force majeure, technical faults, or discontinuation. 3. NO SERVICE CREDITS Unless a separate written agreement expressly provides otherwise, outages, interruptions, degraded performance, unavailable downloads, delayed support, or other service issues do not create entitlement to service credits, penalties, compensation, or refunds beyond any remedy required by applicable law. Mandatory consumer remedies remain unaffected. 4. SUPPORT Unless Provider expressly agrees otherwise in writing: (a) technical support is provided on a best-efforts basis only; (b) no specific response or resolution time is promised; (c) support may be limited, changed, suspended, or discontinued; (d) Provider is not required to provide telephone, remote-access, emergency, or on-site support; and (e) Provider may decline requests involving unsupported systems, third-party software, unlawful use, unsafe configurations, or matters outside the Software's intended scope. 5. MAINTENANCE AND CHANGES Provider may perform scheduled or unscheduled maintenance and may change, replace, suspend, or discontinue website features, downloads, or Software versions, subject to applicable law. Provider may release updates, fixes, or new versions at its discretion unless a mandatory legal obligation or separate written agreement requires otherwise. Where applicable law requires security or conformity updates for a consumer digital product or digital service, those legal obligations are not excluded by this SLA. 6. USER RESPONSIBILITIES You are responsible for: (a) maintaining backups of important data; (b) maintaining compatible hardware, software, browsers, operating systems, networks, and security controls; (c) installing applicable updates and following reasonable instructions; (d) safeguarding credentials, files, and devices; (e) testing the Software in an appropriate environment before relying on it; and (f) maintaining business-continuity and recovery procedures appropriate to your needs. 7. THIRD-PARTY DEPENDENCIES Services may depend on third-party hosting, networks, operating systems, browsers, libraries, payment services, certificate authorities, domain registries, APIs, or other external infrastructure. Provider does not guarantee the availability, performance, compatibility, or continued operation of third-party services. 8. SECURITY Provider may take reasonable measures to protect systems under its control, but no internet-connected service or software can be guaranteed completely secure. Unless required by applicable law or a separate written agreement, Provider makes no contractual guarantee that a vulnerability, malicious activity, third-party compromise, or security incident will never occur. Users remain responsible for securing their own devices, credentials, networks, backups, and local data. 9. DATA RETENTION AND RECOVERY Unless a specific service expressly states otherwise, Provider does not promise to host, retain, back up, archive, restore, or recover user data. Software that stores data locally may depend entirely on the user's device, browser, local database, or chosen storage location. Users must maintain their own backups. 10. NO VOLUNTARY WARRANTY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROVIDER MAKES NO VOLUNTARY OR COMMERCIAL WARRANTY REGARDING SERVICE AVAILABILITY, SUPPORT, PERFORMANCE, ERROR-FREE OPERATION, SECURITY, DATA RECOVERY, COMPATIBILITY, OR FITNESS FOR A PARTICULAR PURPOSE. This clause does not exclude statutory guarantees, conformity requirements, mandatory remedies, or other rights that cannot lawfully be waived. 11. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROVIDER, M. LANDVELD, NOINBOX.DEV, AND THEIR CONTRIBUTORS, CONTRACTORS, OR DISTRIBUTORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS, OR FOR LOSS OF PROFITS, BUSINESS, OPPORTUNITY, GOODWILL, PRODUCTIVITY, DATA, FILES, OR USE, ARISING FROM SERVICE INTERRUPTION, SUPPORT DELAY, MAINTENANCE, SECURITY EVENTS, DOWNLOAD FAILURE, OR SOFTWARE UNAVAILABILITY. For claims that may lawfully be limited, aggregate liability shall not exceed the amount actually paid directly to Provider for the affected service during the twelve (12) months before the event giving rise to the claim. If the affected service was free, any limitation applies only to the extent lawful and fair under applicable law. Nothing in this SLA excludes or limits liability that applicable law prohibits Provider from excluding or limiting. 12. FORCE MAJEURE To the fullest extent permitted by applicable law, Provider is not responsible for delay or failure caused by circumstances beyond reasonable control, including widespread internet or telecommunications failures, power failures, natural disasters, war, terrorism, civil disturbance, labor disputes, government action, epidemics, major third-party infrastructure failures, or other force-majeure events. 13. SEPARATE COMMERCIAL SERVICE AGREEMENTS A customer that requires guaranteed uptime, defined response times, managed backups, priority support, service credits, or other measurable commitments must obtain a separate written service agreement expressly accepted by Provider. Any such agreement controls over this default SLA only to the extent of an express conflict. 14. GOVERNING LAW AND MANDATORY RIGHTS To the extent a governing law may validly be chosen, this SLA is governed by the laws of the Netherlands, without prejudice to mandatory conflict-of-law rules. Consumers retain all mandatory rights and protections that cannot lawfully be excluded, including protections that may apply under the law of their habitual country of residence. 15. SEVERABILITY If a provision of this SLA is invalid, unlawful, unfair, or unenforceable, it shall be limited or disregarded only to the extent necessary, and the remainder shall continue in effect where legally permitted. 16. RELATIONSHIP TO OTHER TERMS This SLA should be read together with the applicable EULA, Disclaimer, Privacy Policy, product-specific terms, and any separate written agreement. Where mandatory law conflicts with this SLA, mandatory law controls. 17. CONTACT Provider: noinbox.dev Author: M.
